Mythbusters did this, and busted it IIRC. If a bullet truly goes straight up in the air, loses all momentum, and is only accelerated by the force of gravity on the way down, it doesn't have enough energy to kill anyone other than in the strangest of situations.

But bullets shot somewhat into the air are still coming back down with more than enough velocity to kill someone, and getting hit by a stray bullet has got to be a pretty terrible way to go.
