Regardless of how you do it, getting ahead of the guy with the paper work is always going to benefit you. I hope you did the right thing and found some sort of legal support because with the video evidence, and as everyone else have said, you have some sort of case.
Also please ignore people who are saying the one who rear ends someone is always at fault, blah blah in Cali. That's not true. Before anyone acts like a lawyer, start referencing laws.
