I currently use a corteck tailbag and a duffle bag attached to the top of that. Which I mount to the bike only using the passenger seat and have never had a problem. And besides the seat latch isn't that much different than the systems they use for quick-lock side luggage. they don't have a problem with liability issues there. I will probably find an extra passenger seat and do my own. It would just be nice to have a metal base than a plastic, but I don't have a computerized 3-d CNC machine.
