Your facts are a little twisted. Back in the end of February, Matt offered to take the kit back at 75 cents on the dollar (excluding shipping). He was OK with the fact that it was modified. He said: "I know TB is heavily modified. But we can replace it with another one." He has never asked me to return it to be replaced with a new TB.
Matt did say that he would be shipping me the new fuel tap and regulator. He said Feb 23: "I will send you these 2 parts, without charge when I have it. So that you can still sell the kit." But I haven't received those either and don't expect to.
Jiggles, Did you get your new TB yet? Did Matt ask you to return your old one?
