Yup..My thoughts exactly. I just talked to my friend (who is a lawyer) and he said, according to the law, whoever receives the money (distributor = seller to immediate buyers) bares the responsibility. In cases such as this, if there is a lawsuit, Vince will be named as a plantiff.

Vince, I wouldn't count on Paul fronting you items. If you want to be a distributor of shinto you need to understand what a distributor does. This is the definition of a distributor straight from the internet.

First and foremost, Vince has been very kind to us to go out of his way to establish SHINTOUSA, and offer us the lowest price available. He's been especially understanding and more than generous to refund my order before all this happened (I knew the whole 30day waiting period was a risk to consumers). I think everyone feels the same way. So a big thank you goes to Vince.

With that said, Vince...take what others are saying to heart. Meaning, we thank you for the work and we're looking out for you. Continuing business with Shinto will sooner or later bite you hard...even if he fronts the items (which I doubt will happen). Based on Paul's pattern, you guys will eventually come into disagreements about money and what not further complicating your business relationship and possibly ending in a bad note.

And I've mentioned this to you via PM in the past but there's a lot of loopholes in your operation and it takes just but one person to bite you hard to end your line of work or even worse cause you financial hardship and maybe even costing your current employment (whatever it is that you do).

The whole 30 day waiting period is a consumer risk because you're given 45 days to dispute any charges through paypal. And though the 30 day policy may be Paul's policy it's not our country's policy. Meaning, if the product is on backorder, the customer has the right to ask for a refund and you would have no choice but to issue a refund. And sadly, the funds used to refund that customer would come from someone else's order. Also the packages aren't being sent insured. So what happens if the item never arrives at the customer's door steps or it arrives damaged? Guess who's footing the bill...not Paul.

I've been following this thread because I guess in the end there's a small hope that Paul would come through for everyone but based on his pattern I highly doubt it. I honestly believe his excuses are to mask some other issues. Maybe he's having an inside source make these during non-work hours and that person's time is limited hence the delay. Maybe he's in price dispute with the manufacturer. Maybe he can't keep up with the demand...I don't know. There's just too many "maybeees". But what I do know is even if he did come through Vince the delay/excuses will happen again.

You can't grow a business when your current customer's orders aren't being fulfilled. How does that make sense? Sounds like another excuse.

Is he a legitimate seller or a scammer? Personally, I think he's a scammer. How do I know this? From personal contact dating back to Dec. 22nd, 2010, as I wanted to find out more about his operation and how his inner dealings work he had asked me to foot $15K USD to become a distributor. $15K??? WTF? Dainese doesn't even require that much to become a dealer let alone Trucker Rocky who are a multimillion dollar company. Yeah, I'm going to foot $15K USD and sit here and expect him to deliver the products? He might as well be Paulwaga from Nigeria.

Seriously Vince, it's not worth the risk. But if you do plan on going forward with Shinto you gotta make this legit--stocking inventory, storefront, insurance, merchant account, logistics, etc. And if you're not willing to go that far just know we did warn you as one caring Ninjette member to another.

We're only saying this because we care, and thank you for all your work.

whether he is a scammer or not, its the fact that paul doesnt keep in touch with his customers promptly that makes his business so terrible. he has the poorest communication skills ive ever seen for a businessman. and to top it off his orders have no set time frame. even though he markets high quality parts at competitive prices, i will never put my money into shinto as long as it keeps running this way.

wow ive been keeping up with this thread since i joined thinking that i might order a few parts from shino but after reading all the bad happenings and long waits im better off having some make me the parts i will need. either way i hope you guys get your parts or your money back.

I can't help but think that there is a great opportunity here. Is there not a small company in the US that can make small run production? I am half tempted to take this on. Vince has always been quick to reply to my pm's so I think he is a good guy. Problem is trying to pre-sell a product that does not exist yet... in Thailand... Again, I ask. Is the market to small? Could be? Somebody tell me how many 250R's have been sold since 08? Seems like Hotbodies does not have one. You can go to the UK or Japan (very quick to reply and ship but $$) Come on Umerica! make my stuff!

Hi Guys.
1st ... Vince i hope i am not stepping on your toes by inquiring about Shinto on the forum members behalf. Random sent me an email asking about Shinto.

Ok. I am just relaying what was said this morning when I spoke to Paul. He told me he has sent an email to all that inquired this morning.

He has told me that he is currently moving into a new building/ retail shop having just gotten back from Japan. He also told me that the reason that you have not received your outstanding orders is that he has not received the outstanding shipping payment from Vince (i said that Vince had paid it all) he then told me that Vince was asking for next day dhl (or similar) so had to pay more.

As for lack of email answer. He informed me that the website email was on his computer so he could not access it while away ( i said if he held his site on a server then that should not be a problem. and was informed that he does not know how!)
I also asked if he had the stock. He said YES so i then asked if i could come and photo the stock to send to you guys.. he said Yes BUT he is moving at the moment could i come next week!.

This is not really my problem, But if i can help i will.
In a slight defence of Paul he sounds like a nice guy but i think he has just got in over his head. It is extremely difficult doing business here in Thailand. If you have a good idea some one steals it within days / weeks. Also the suppliers are haphazard at best.

You might want to relay to Paul that if he wants to do business in the US in the future, he needs to come into this thread and answer questions directly. I find it appalling that he has not stepped in as of yet to help straighten out this mess, if he is indeed sincere and legit. I know that's what I would do if I were in his shoes.

His reputation and his company's reputation is at stake here.

Kim.. I did mention a few things to him. I also made sure he was aware that you guys knew about Canada.

If i were you i would ask for Thai post EMS delivery.. It is fully trackable and can be done at any post office here so no excuses really.. it gets delivered your end by USPS. So you may also save on any import duties??

I realized that it was the correct number on his website. He had just forgotten to put the country code +66 before it.. he told me he thought it was different for different countries.

Any way i hope it all works out for you.. What you guys need to know about the bike scene here is that it is very, very new and it is just now being established.So there are many small shops that do not hold a lot of stock popping up all over but no proper distributors or wholesale shops.

So it can be very, very difficult to sort out stock IF you do not have a factory.

I can put you in touch with an American guy that i know here. motorcycle parts are NOT his main business but he knows loads of people and where the parts are.. Thats if ya want.

I think an additional source would be great. The demand for the parts I believe is there yet many are holding back waiting to see how this SHINTO thing ends up playing out.

First, thank you Allan for helping us in getting in touch with Paul.
In regard to Paul's comment of about the funds...WTF? money was wired to is account (per Vince) and per Paul email, he acknowledged that he saw the money ("a few hundred bucks...what is this for")...yet he is now still standing there saying he "doesn't have the money"? My 4 years old nephew could have come up with a better "excuse." Apparently this dude lies without knowing how to cover his own tail.

..and finally, per Vince, the money wired to him = to money he (Paul) asked for...

So now we need to make it damn clear to him...HOW MUCH IS PAUL ASKING...and HOW MUCH HAD HE RECEIVED. But in the end, this little bastard is a lying, scamming scumbag so it probably makes no difference.

Thank you very much Allan for getting in touch with Paul. You're doing us all a huge favor. We owe you big time.

I personally, don't think Paul has our stuff and that is why he asked you to give him a week before taking pictures of it. Just another excuse.

Also Allan, you mentioned EMS shipping to us, did you happen to mention that to Paul as well? If you plan on calling him next week for the pics, could you please mention to him that you think he should just fork up the additional costs for shipping EMS, to make his customers happy and to move his company's reputation in the right direction.

Random - Paul has the correct amount of money to ship. He told Allan that Vince is requesting next day DHL service, which I would imaging would cost alot more than what Vince gave him for shipping. Personally, I think Paul should just front the additional cost of the shipping, for putting us through all this hassle. But we all know Paul is not that kind of guy.

to be ABUNDANTLY clear:

regular mail is cheap and SLOW (stuff tends to get lost as well - ask randomwalk)

every shipment i've received thus far has come via mes, which turns into DHL when it hits Hong Kong(quick and reliable)

paul and i split the costs for dhl shipping

shipping is usually $400

because 4 pairs of clip-ons and 8 pairs of fork caps were not sent with the last shipment, paul
offered to ship these at his expense when ready.

due to the delay it made more sense to ship these items with everything else
so my portion of the shipping for these orders is $150

on 12/17/10 paul received $480, $150 for shipping and $330 for unpaid items

so CLEARLY, everything is in place and should ship immediately

also, i have not heard from paul since his message earlier this week, that and his "happy holidays" message is still on......

Is this B.S. or not? Vince paid the guy but now wants more money. Or was the amount never specified to Vince?

[EDIT - I just read Vince's post above mine...clears up my post above]

In either case, the dispute is between the vendor/distributor, not the consumers. Paul needs to get the products out and collect the difference through Vince. It's not the consumer's problems.

But like Nat said...I don't think he has the products in hand which is why he's throwing out excuses to delay time. And even if he does have the products get them out.

From and to Thailand EMS is very fast (for post office) normally i have received items sent from the US within 5-7 days. And stuff shipped took 7 days to Minnesota. It can also be insured at this end.

You can get it quicker but it tends to be more expensive. I was just offering choices.

Any way.. It's up to you guys.. If you want me to go have a look. ok

This is true. Basic mail = cheap, lost mail
EMS has tracking and when package arrives at US it turns over to DHL

Na. Thats not Paul. As far as i'm aware that is a Thai shop/ manufacturer. They DO also sell here in Thailand.

I know someone who has seen their factory.

Much is appreciated with all your help trying to resolve the issue with Paul. I don't mind sending you a few dollars via Paypal to compensate your for your time and efforts at all.
Any others who would like to contribute please let us know.

Please follow up with Paul next week confirming he has the goods ready to ship as he said.
Also please inform him to ship it via EMS with tracking (DHL once in US as he always ship stuffs and not overnight/next day DHL delivery as mentioned (I'm sure Paul knows this already and was just acting ignorance as an excuse). And of course, ship it.

Random.. The bit about the beer was if any one wants me to help about sourcing parts in the future eg; buy from 517club so therefor they will make money

There is no need to worry about it for checking pauls place..
I offered that

Vince or whoever ordered needs to ask for that. I'm pretty sure that EMS is delivered by USPS.
