I got pulled over for lane sharing!
So I'm riding home and come up to a light and I see a cop car so I do what I always do when I see a cop, ride like I normally would. I lane split past him and he shined his light on me and then turned on his siren. I pulled over and he gets out and tells me I almost side swiped his car. I told him I was just lane sharing and I wasn't close to hitting his car. He said I was 3 inches away from hitting his mirror (lol?). Then he says I'll bet you're one of those guys that does wheelies on the highway . He then says what would you have done if I decided to change lanes? And I told him if he did he would have hit the car next to him.
He then asks me if I had ever fallen and when I told him I hadn't he said it's going to happen one day and I'll end up with a broken leg. When he went back to his patrol car I just laughed and rode away.

In Texas you would have, at a minimum, gotten a ticket for illegal passing. That would be if you were lucky and the cop was in a good mood. He could just as easily arrest you for reckless driving, a jail time offense.

Mine and most pre-gens. And new-gen bikes that have a higher rev-limiter from either a 1995 or older CDI conversion or one of those adjustable CDI's from Sportisi Before they lowered the limiter, it was 15,000 rpm. Mine is 14,500 rpm. Later bikes have 13,000 rpm as their limit. (is 13,000 also the limit for new-gen bikes?) anyhow, a pregen on stock sizes with do 56.9 mph at 14500 rpm, and with 130/90-16 tires like mine has, it will do 59.3 at 14,500 rpm on stock gearing. However, I recently changed my gearing to 14/47 which lowers that to 56.7 mph at 14,500 rpm.. http://faq.ninja250.org/speed/#noredir |

I have to apologize... I'm sorry. I'm pretty sure that was my cousin that pulled you over. I feel responsible because I was one of his personal references when he applied, and although I don't really know him, I'm pretty sure he only asked me because he thought my profession might have some weight (doubt it though, being related and all). I guess you could say I gave the expected reference for a "family" member," but deep down I knew he would live up to every negative stereo-type. The last time we spoke he was yelling at me about how he couldn't possibly be expected to know the law...... yeah, I'm not joking, nor am I exaggerating. Watch out when riding through Amador County (where lane sharing is just as legal as anywhere else in CA).
Regardless of where you are, it is always a good idea to keep your distance from cops. It isn't always the smartest idea to assert your rights, just because you can, unless you have a darn good reason to.

Not to be too nit-picking, but it is more accurate to describe lane splitting in CA as not being specifically illegal, an important legal distinction. If a cop in CA decides to write a ticket to someone in CA for lane splitting it will be for an infraction such as reckless riding or other related violation. This bit of verbiage from wiki describes it best to me: Motorcycle safety author and consultant Pat Hahn wrote in his 50-state handbook of US motorcycling laws that, "Lane sharing with vehicles other than motorcycles is not legal anywhere, including California. However, it is tolerated in California to large degree" and that "California is the only state in the country that allows lane splitting, lane sharing, and filtering. However, contrary to legend, it is not legal. Nor is it illegal. It falls in a gray area unique to California … You can (and will) get stopped and cited if you're riding like an ass." |

More importantly, the cop has to perceive it that way. Cops are humans just like rest of us and are subject to all the same perceptual biases as anyone else. The difference is they can act upon those perceptions with the full force of the law to back them up. The OP would be wise to accept this as a lesson learned.

I would assume it could be safely performed at either a stop light or in heavy traffic..any situation in which traffic is stop in such a way that you can safely manuever through it...and I thought you said this happened at a light?

People do this all the time the other way around to me and I hate it. I'll be stopped at a light, and some idiot car driver will snug right up on me and push their way through to turn. Then I wave and yell, and they just look at me like I'm interrupting their phone conversation.
