Backed into my bike

Dint exactly crash but my bike is still messed up Had the bike parked in the parking lot at work, in the bike area when someone backed into it.
I was working on a roof when i heard my name on the radio asking if i could please go to the parking lot.... i knew something had happened to my bike as soon as i heard that, i could feel it lol. When i get to the parking lot i see my baby lying on its left side bleeding gas An ac service guy backed his Dodge Ram 2500 long bed (loaded with equipment) into the bike. He said he barely touched it... He hit it on the right side and made the bike fall on the left... Picked her up and looked at the damages
LEFT Side
-Left body fairing deep scracthes above the ninja logo
-Left tail section cracked and scracthed (loosened brake light)
-Clutch lever loose but intact also needs paint on end.
-Shogun bar end scracthed
-Left mirror broken (dint break the front fairing but did scracth the paint)
-Kick stand flaping in the wind and is bent far out, (lucky i have stands)
-Side and rear turn signals trashed but still work!
-Not a mechanic so i cant say 100%, but when I aline the front wheel with the face of the bike the handle bars end up unequal in the distance between the handle bars and the corner of the gas tank... (a mouth full i know)

RIGHT side
-Has previous damage from super super slow low side (walking speed on gravel) But i believe some of the scracthes are new.

Going to take her to SD tomorrow to get an insurance quote for the damages, glad the guy stayed and fessed up and that he had insurance! Will post pics when i finish cleaning her up abit.

The insurance will try and scam you. Be prepared for that. If they ask you if the bike had any minor cosmetic damage prior to the accident, say NO - regardless. If you say yes, then they will argue that all of the damage was there to start with.

That sucks man. Hope everything works out. He hit it from the right and it fell over towards the kickstand? Sounds like he did more than barely touch it...Was there any divet into the pavement from the kickstand digging in?

I remember when my downstairs neighbor's bike was knocked over towards the kickstand. The guy was trying to back a truck into the spot and not paying attention. You could definitely see where the kickstand had dug in....

I've had a few times where people get really close to my bike, I stare at them and kind of freak them out. Then they scatter away and go to another spot. Sorry your baby was hurt, milk that guy's insurance till you get what you want.

Thanks guys, havent checked if my kickstand dug in at all will check on monday. I already had damage on the right side from a drop and a small slide i had when i first got the bike. I didnt think twice about telling him what damage was already there , i assumed they would be fair but ive never been down this road Ill just have to wait and see what happens, i hope they dont try to take advantage of the fact. Gota give props to San Diego House of Motorcycles though they have top notch customer service, really friendly but not overbearing

Got the news today, bike is a total loss theve given me two options:

- $4200 minus 500 deductable wich comes to a grand total of $3700
or
- Take the bike (salvage title) plus $1600

$3700 is barely going to cover the rest of the loan i have on the bike. Im leaning towards taking the bike, most of the damage seems to be cosmetic in nature but i have to talk to the mechanic at the shop. Several months ago i purchased almost all the fairings and parts that were not wanted off an 09se from a member who was going to use the bike at the track. All if not 99% of the parts that got dinged up i have already. Just hope the forks dint get messed up. What do you guys think... she only has 12000 miles on her

Why would you have to pay the deductible if it is the other guys fault? His insurance should pay you the full amount.

Nice catch guys, will ask the adjuster. As far as i know this is how things are going down...

Going through my insurance, not at fault, then my insurance will bill his.

Reason why im going this route is, the guy who hit my bike was using a truck that was his uncles during company time. When he gave me his insurance info he gave me his personal insurance (insurance#1 so its easier to remember). Unfortunately after waiting a week i was told this insurance wasnt going to cover it because the truck was not listed under his policy... so i was sent to insurance#2 (the company's) because he was doing work for the company. Insurance#2 made me wait another week and then told me they couldnt do anything because the truck was not theirs. They said that first it needs to go through insurance#3 (insurance that covers that perticular vehicle) and that they need to decide if theyre going to cover it or send it back to insurance#2 and that it would take a long time. At this point i was getting tired and angry. So I was told by the other insurance to get my insurance#4 involved to solve the problem quicker instead of waiting for a longer process.

Soooo should i still ask for the deductable lol

YOU SHOULD NOT!!!!!!!!!! pay a deductible. it is not YOUR fault there should be non UNLESS they are saying he didnt have insurance then there may be a deductible for "uninsured" motorist. BUT he does and they just need to sort it out and get the money from the other ins. company... and if that happens I dont know why they would want a deductible from you? what ins. do you have?

Just finished talking to adjuster, they will waive the deductable sooo that changes the numbers abit.

- 2400 + bike and salvage title
or
- 4200 and no bike

Take the 4200, pay off your loan, and go get a brand new bike.....might not be a 2012, maybe a 2011 but still new

Well that would be my choice

Unless of course the repairs are less than 2400 and bike is like new once fixed, and if there is any money left over you get to pocket it, or use for mod's....

I still owe 3500 on the bike unfortunately. so that would leave me with about 700 bucks in my pocket. Maybe for a down.

you need to figure out what exactly is all messed up to see if that would be possible to fix up...


dont forget though it will then have a salvaged title and will NEVER be worth anything close to what you paid for it. or what you put into it.

In your case, I would take the $700 and put it as a down payment on a new 2012. If you take your bike back with a salvage title, you'll still have to pay the difference to the loan company and you'll end up with a junkyard bike regardless of how much money you put into it.

That is to say, if you take the bike and salvage title, you still owe the bank $3500 less the $2400 the insurance will give you, this means you have to pay the bank $1100 immediately out of your own pocket. The bank will not allow the title to be converted to a salvage title without getting the loan paid off. The only advantage is that the bike will be free and clear.

I would talk to the insurance company about the salvage title thing and tell them you might consider it if they give you a regular title.

Another thing, always remember that the insurance company didn't run over your bike - the air conditioning company did. They are responsible for your damages. Your other option is to send the A/C guys the bill for repair or replacement.

Regarding your stash of kawi parts, you do have the option of selling them on ebay to help offset your expenses. DO NOT give them to the insurance company - or tell them about them.
