Dreadful Morning of 23 May 2016...

It was early morning on the 23rd of May. I was sound asleep. Drifting through my dreams as time passed by. Suddenly I heard a loud bang! I was on the couch, fell down and shocked by the sound!

I quickly looked at my clock. It was 04.30 in the morning. The Television was turned on. I got up and with haste, pulled out the plug from the socket on the wall. Heart was still beating. I was sweating and hoping that the thunder which struck my home did not result any further damage.

After few seconds passed by I felt weird. Thinking that if there was a lighting strike, the electricity fuse would be flicked down, hence the house would be in total darkness.

The corridor light was on. The living room light too was still on. A smell, such as gasoline and motor oil filled up the living room. A smoke could be seen coming in from the window. I brave up and opened up the door.

There it was. It was an industrial vehicle, with smoke coming out of the engine has rammed to my home. Both of my bikes, the moped and the ninjette lying helpless in an aftermath. As if Zeus has fought a war with Hades........

I hope you have an insurance claim at least... just looking at that wreckage looks like a nightmare, I can't imagine what you must have felt being there, seeing your bikes like that.

I cannot claim on the house since it is a government living quarters. The ground floor portion is a rural / suburban clinic as my wife is a nurse.

I have called up my insurance and inquired on the details. The problem was, they would not fully insure the bike. The most coverage would be 80%. As I was on my way to get a copy of the police report, I phoned the inspector (in US i believe the rank is detective), and he informed that both the driver and co-driver of the lorry was positive on their urine test.

Later I phoned up the supervisor of the company of which the vehicle is registered to (I got the information from an acquaintance of mine from the land transport authority office) and ask for a compensation.

At first he declined (as usual). However he halted and offered to see me (when i told him that i know where his office address is and would meet up his Managing Director, and also I have the knowledge that both drivers were positive in their narcotics tests). The meeting is to be scheduled on this Wednesday, 1 June 2016.

I would not go after the non-quantitative damages (as for disruption of daily routine, psychological etc.. etc..) I would only claim for quantitative damages, that would be proven with an official receipt of Kawasaki Malaysia. I would then sign a letter of indemnity relieving his company from any further claims.

If he declines, than i would file for a hearing.

As for the accident, he has to pay compensation to other parties :

1) Ministry of Health (as the house is a living quarters for their nurses)
2) Municipal council authority (the lorry also hit a bus-stop)
3) Telecommunication Ministry (again, the lorry hit another government facilities).

Please pray for me and hopefully the company will settle all of this outside legal proceedings.

The policeman told me that both drivers suffered mild injury. The real injury for them is jail time. Wreckless driving and under the influence of illegal substance. I am still thinking to take a lawyer with me, but then again, even without a lawyer present, the company would still be charged with negligence bc not screening their employees properly.

Take a lawyer. You are outnumbered without one. The attorney will know the details of the law and may be able to identify liabilities that you may not be aware of this being not a regular occurrence in your life, thankfully. Often times people want to be fair when they are aggrieved, maybe not realizing the full affect of someone else's negligence on their well being or property. In the US, the attorney is often compensated out of the damages awarded, but you need to know upfront if that will be the case or not. It never hurts to ask.

Holy ****, dude! Did the police expand upon what substance the drivers were under the influence of? Do you guys have the equivalent of renter's insurance over there? What about your motorcycle insurance?

Between one of the insurance companies, you should be able to file a claim and get a new bike, if the company refuses to compensate you.

And yes- bring a lawyer. Always bring a lawyer. Companies will always try to brush off the average guy as much as possible. However, that's not as easily done to someone wielding the law. At the very least, it'll send a message that you are serious.

Update :

Phoned up my lawyer on this matter. He informed me that there is no purpose for a lawyer to be present during the meeting. According to him:

1) The meeting is just to stress on the gravity of the after effect of the accident.
2) To find a common ground of understanding for both parties, on the quantifiable and non quantifiable damages which have occured.
3) To propose if the company is willing to settle outside legal proceedings.

The company may / may not include their lawyers to be present at the meeting, however any discussions made or decisions made could always be dismissable as this was not a "summon of appreance" for a hearing in court.

Should the company decline, then i would be advised to issue a summon through my lawyers for another meeting. Now, only during that time, all recordings or minutes pertaining the meeting is usable for exhibits in court. This meeting is channeled through all legislative means. Should he is to come with me, i would still be charged for legislative consultation even none of documentations are being prepared. This is a loss for me.

This meeting, should i rephrase based on my comprehension by talking to my lawyer, is a sign of saying;

"Dude, you are screwed."

Yes, my bikes were my only daily transportation. However, i am lucky as my moped was able to be repaired soon enough and is working a-ok as we speak.

but the frame needs some reparing thou.

The police would not disclose such information. The only good part about this is that irregardless of what substance the drivers were hooked on, it will still be prohibited by law. There is no such "medical drugs" or "medical marijuana" in Malaysia. The only ones are psychotic drugs which only be issued by a pharmacist.

i am sorry, i do not get what u mean by "renter's insurance". Could u elaborate more?

Here in Malaysia, there is no such thing as "getting a new bike" for insurance coverage. It is either claim for a total lost, (which later any amount of residue left from deducting of the remaining vehicle loan will be handed back to u and u use it for a downpayment for another bike), or if the damages are just cosmetics, the insurance company will only pay up to 80% and the rest is by your own money.

the saddest part is the tank. The insurance company will only bear the repair cost, including paint job which clearly done by a third party rather than Kawasaki.

I have two modes of transport as well. I know I'd be struggling a bit if somehow both of them got taken out at the same time.

Abu, sorry to hear about this incident.

Also, it sounds like people and insurance in Malaysia SUCK. It is beyond me how you can call up the owner of the lorry company and he can at first deny and decline ANYTHING!!! How is their liability in question? Is this guy an idiot? lol.

I hope it all works out for you.. I am utterly shocked as well that your lawyer would not come with you to the "dude you're screwed" meeting.. if even just to charge for an hour of his time. It seems to me, even in a meeting like that, you'd want representation.

I mean... you think they wont be bringing their lawyers? Yes, yes they will. Or at least consulting them.

Hi guys... a little update on the incident.

I have met up with one of the director of the company pertaining this matter. After disclosing documents from both parties (mine and his), it looks like I do not have any prima facie against this company after all. The lorry which carried the cargo was leased from another company. The company also provide with the drivers. It is a small company, with only having two lorries for leasing and the company registration's address is a home address with no occupants at the moment (they probably moved out years ago).

The cargo company (Sesama Logistics pte ltd) leased the lorry from a third party, since they do not have sufficient lorry to carry their cargo. It is a sterilized latex gloves, to be exported to Germany. The lorry company (Al Nour Pte Ltd) is in a business of providing lorries and drivers. A very small company indeed with only two major stockholders and both are also the directors of the company.

What Sesama Logistics could assist me with is to hand over the judgement call for the accident and their copy of the insurance policy of the cargo for me to claim on.
