Buying this, any thoughts?

Looks like I'll be back very shortly...

check this link and let me know if this seems okay

http://longisland.craigslist.org/mcy/2291237515.html

and if i should be concerned about any of the mods he's done. I would just like some expert opinions/advice

I very well may be welcoming myself back.

and where the cheapest place to get only one fairing would be =P

Ninja 250 - $1700

2008 Ninja 250, Blue, Aprox 5k miles, I changed the front and rear sprockets so the bike wouldn't over rev at highway cruising speeds, I have included several different sprockets with the bike. I also installed lowering bones so you can either lower the bike for the vertically challenged (like me) or raise the bike for the extra tall rider. I had Carburetor installed pods and had the bike professionally jetted with a Dynojet kit, I dropped the bike on the right side and damaged the right side fairing but there is NO damage mechanically, this happened when I first purchased the bike new but I have been riding it ever since. I can replace the fairing but would have to raise the price around $275.00. This is an excellent first bike or a great 2nd bike because of it's excellent fuel economy (at least 70mpg) Also included is a rear cowling that replaces the passenger seat (comes on and off in seconds) I have put a good amount of money into this bike and it is WELL worth more than I am asking. The pictures were taken before I dropped the bike and before I removed the aftermarket muffler (the bike was too loud) so I put the stock muffler back on.

$1700 seems to be a damn good price. Almost too good for a "mildly" damaged fairing. If you go and take a look at it and see what kind of damage it is and how it runs. With all the service records and paperwork that's valid, I dont see why this isnt a fantastic deal for a newgen.

That seems way too good to be true, it screams scam to me. JMHO.

Saw it earlier, gave him a deposit and said I'll be back. Got a written receipt for the deposit.

The right fairing is basically shattered but held together by tape. The pods he installed were there and the lowering links.

Bike started up and he took it up and down the block so i can see it run.

He said only problem is there's a lien on the title. he claims its been removed since he claimed bankruptcy =/ only thing im not too sure about.

he said he'd sign a contract saying if the lien causes any issues i can get my money back and return the bike.

we'll see when i get to the dmv or whatever

Run away until he can fix the title issues. He may have no legal right to sell the bike.

if there was a lean on it you wont get the title

from what ive read around
the lean holder either makes you pay for the remaining balance
or you will never ever get the title

check your state laws
many states wont allow the sale of a vehicle without a title

I have seen a few ninjettes around my area with leins for around $2000 and never took a second look at them. If the bike is on lein then it isn't theirs to sell honestly, It's the banks property until they pay off the loan.

Lien on title means the bike belongs to lienholder until it's satisfied.
I would not move ahead with this.

I would get the vin# and check to see if it's been reported stolen. His story seems sketchy.

While I agree with the others, It wouldnt hurt giving him the benefit of the doubt. If he is willing to go through the trouble getting all the paperwork sorted out for you, meaning lien taken care of and title/paperwork ready to go and mechanically the bike checks out, I dont see why you shouldnt keep in touch with the guy. I know a few friends hit with some hard times and as long as he is reasonable and gets you everything you need to make it a CLEAN sale at a decent price and you arent in a hurry then it's really not that much of a problem.

Eh, He needs to get a "pay off letter" from the bank to go with the title. This is true for anyone who ever buys anything with a loan.

What part of LI are you from?

Geting a copy of title used to be a PITA in NY.
Call your insurance broker and tell them the situation and they may be able to run the vin and see who actually owns the bike.
If the seller is the current owner that doesnt necessarily clear it...you said there was some damage...be sure the bike does not carry a salvage title...in which case the bike is not registerable unless it's been repaired and inspected to the satisfaction of NYS...which can be expensive and very time consuming. If the bike is, as he says, satisfied then it's going to be very time consuming for you to contact the bank and get a pay-off letter...whose the lienholder. To get a payoff you need a loan number as well as owner and vehicle info and if the guy is in bankruptcy you'll need those specifics too. He may have filed for bankruptcy but that does not mean it's been granted. The price is really low...too low...but look out...at that price...it smells like a salvage title...IMHO.

Declaring bankruptcy and getting it through the court system are two different things, and that doesn't necessarily remove a lien on something and give you the right to buy it from him. You may be able to buy it from the lien holder to satisfy that debt. You may need to check all this with a lawyer. Without a clear title, that bike is worthless to you and you are out $1700 and I doubt you would get it back from him, with or without a contract, as he would spend it on something real quick, and he has declared bankruptcy, has no money. etc., so now you are screwed.
If the lien is from a local bank that he owes money to, you can arrange to go with him to the bank and pay your $1700 purchase price, and with him adding whatever is needed, or getting the extra cash surplus, you get a note from the bank that the lien is satisfied, you can get a notarized bill of sale while you are there, and if you arrange it ahead of time, you may get the title right then and there too, all signed, sealed and delivered and legal. If this is a legit deal, he shouldn't have any problem doing that. Otherwise, get your deposit back ASAP and ask him to call you when the title is clear. I hope you don't have any trouble getting your money back, that will also tell you how legit this deal is. If he won't go to the bank with you and makes up some excuse, and if you do get your deposit money returned, I would be glad and then run.

Get your deposit back, now. Seriously. The bike isn't his, he can't legally sell it, and though you can give him money and physically take the bike it isn't yours and cannot be. In fact, if he "sells" the bike the bank can report it stolen, which in fact it would be.

Only the lienholder can release the lien, nobody else can, and typically during bankruptcy proceedings the lienholder seizes (repossesses) the bike and sells it at a public auction.

Rule number one when buying a car or bike: Clear title in the seller's name with no liens.

Unhappy

It is likely that the seller is not going to return the deposit.
Parting out the bike is an option to minimize the loss.
Tough lesson to learn..

You cannot part out and sell what you don't legally own. That's a separate crime. How hard is this to understand?

Legal or not, I would consider parting out the vehicle to be an option if the seller is not going to return the deposit.

Heck, I would beat the sh!t out of the seller and take the bike from him without paying the balance then part it out.
