Question Buying a bike, 2010 gas tank worry

I went to look at a 2010 ninja today. I have one worry though, the owner said that he was having trouble with the gas cap lock so he removed it. That sounds a bit suspicious in the first place. Also when closed the gas cap does not sit flush with the rim of where the cap fits, it sits about 1cm or .5cm lower. It seems as if it no longer seals. Is this a big problem? If I buy it I will get an aftermarket gas cap. However, would this possible have let some water in or allowed rust?

I doubt any water got in. There's a rubber O ring that seals the cap. You said it seems as if it no longer seals. How do you know that? I would think that if the cap was letting a significant amount of water into the tank, it would run like crap and you would be able to tell pretty quick.
