Dude. This thread is years old. Check the dates before reviving old threads, they're dead for a reason.

Yes, the driver of the car may have been on a phone, but the guy on the bike was traveling at 80 MPH. They're both at fault. He could have potentially avoided the accident by riding at a lower speed and she could have paid more attention and been on the phone.

Everyone's always so quick to blame the car driver.

Let's parse this a bit, shall we?

If the rider shares blame at 85mph, presumably over the speed limit, would he share blame if he'd been doing the speed limit or less? How much blame, 50%? Does that percentage decrease linearly as the rider's speed more closely matches the posted limit? What if the rider had been doing the limit and the driver still caused the wreck, is the driver still fully at fault? BTW, the text in the earlier post used the pejorative phrase "crotch rocket" which implies, to me anyway, bias against the rider in this case.

The whole concept of percentages of blame came from lawyers trying to get their clients out of bearing full responsibility for the consequences of their actions.

i'm placing more of the blame on the biker though, there no way you should be pulling 80+ mph along a normal street...

depending on the road, sight distance could be inadequate for both rider and driver once you exceed the speed limit.

even if the chick was driving perfectly, and took off after looking both ways. the rider may not appear until or react until its too late. it takes over 238ft to stop if a rider reacts perfectly if you estimate 300 feet to include reaction bad tires, bad brakes etc. where it might take a third of that to stop from the speed limit.

if the rider lived through it he would have gotten charged with manslaughter.

cover your brake when you crest hills or approach curved city streets.

Stop right here. Here's the problem. You're coming up with a situation that NEVER HAPPENED. Fact is the guy was speeding. Were he going slower then his chances of avoiding an accident like this increase. I'm not saying speed kills, but it certainly doesn't help things get better. If it were true that the rider were doing the posted speed limit, then yes, this would be the car driver's fault. Yes, the percentage of fault does increase with the speed. That's why you pay more money for your tickets or land yourself more serious charges and punishment the faster you ride on public streets. If there are side streets then chances are pretty high that the limit was 40 MPH or less. At 80 MPH+ that's double the speed limit, an offense that will get you arrested. I've never seen anyone arrested for simply being on the phone and driving, but I have seen them get ticketed.

I'd say doing 85 MPH on a road where there are side streets is a lot more reckless than being on a cell phone. Note, I'm not supporting being on the phone while driving. Just saying, all motorcyclists are always so quick to blame the car driver. Well, guess what, idiots drive all sorts of vehicles, both cars and motorcycles and they are EVERYWHERE. SO, don't be an idiot.
