Are You now a Felon?

Talking with an officer tonight. Apparently in the state of TN at a minimum it is now a FELONY to swap a tag from one vehicle to another. On top of that they now have the confiscation card and can confiscate the vehicle you are driving at the time of the discovery.

While never legal tag swapping has been common on bikes in the south since the invention of tags and titles.

Things you can no longer do if you have a felony for ANY reason:
  1. Vote
  2. Own a firearm
  3. Get a job
  4. Keep a job in many cases
  5. Leave the state in many cases

Don't even try to justify this nonsense to me. I just wanted to warn everyone. Park that bike if you don't have a clear title or it's own tag.

I live in the people republic of Maryland. That's how it is in Maryland. It is better to drive with no tag. Like if you just bought it or are going for inspection. Wrong tag and you loose the bike and go to jail.

There's a lot of strange laws down there in TN. I heard if you get divorced you can still remain brother and sister. That true?

I don't think they rescinded that law, but at least the relationship is consensual. You'll never be able to say that about the Joliet punk style relationship y'all have with those politicians though. You a politician, or a punk?

According to them it's often easy to get out of trouble. Just plead Nolo Contendre (no contest) and sacrifice the property to the LEO. It then gets auctioned off and turned into money.

That's absolutely insane. Felonies should be reserved for seriously violent crime. Stripping someone of constitutional rights for having the wrong plate? Who votes for this stuff?

well that's just stupid. I'm sure the original intent was to punish people for stealing tags and putting them on stolen cars, but at the expense of common citizens going about their lives. Seems like law makers need to take some inspiration from other states. MA has a 7 day rule... you're good to transfer plates to a used car/motorcycle for up to 7 days... A 7 day rule makes a lot of sense, and allows you to buy a new vehicle and drive it home.

"..A person who has attained 18 years of age and who transfers the ownership of a registered motor vehicle or trailer owned by him to another or who loses possession thereof and who intends to transfer the registration of such motor vehicle or trailer to a newly acquired new motor vehicle or newly acquired used motor vehicle of the same type and having the same number of wheels may, subject to other provisions of this chapter, operate such newly acquired new motor vehicle or trailer or newly acquired used motor vehicle or trailer for a period beginning from the date of transfer until five o'clock post meridian of the seventh calendar day following the date of transfer within the period for which the transferred vehicle was registered; provided, however, that the registration plates issued upon registration of the transferred motor vehicle or trailer shall be attached to the newly acquired vehicle. During such period any operator of the newly acquired vehicle shall carry an original copy of the bill of sale reciting the registration number to be transferred from the former vehicle to the newly acquired vehicle or, the certificate of transfer issued by the dealer on a form approved by the registrar in place of the certificate of registration...."

@Klondike1020 read the dwi laws here for starters... Your guilty from the start, even being found not guilty wont remove some of the punishments imposed.

Actually found out this info from a cop the day I bought my 300, about 2 weeks ago.

I had to follow the guy to the bank to get title..from there ride it home.
I had my old tags on the bike, the ones I planned on renewing to that bike, and the registration for those plates.
Only thing that really saved me was the bill of sale, notarized on that same day 1hr before being pulled over.

Bike sat the rest of week until I got time to pay the tax/title+new plates, the Friday after I bought it.

Every state is different. Some states the plate is married to the vehicle and goes with it when you sell it (California) while in others it is yours (you paid for it) and it can be used on your next vehicle if you update the registration within a certain number of days and the vehicle type and wheel count are the same (GA, MA). You can't use a pickup truck tag on motorcycle though.

That's just it. The politicians don't give us a chance to. It is simply taxation without representation.

Here's the kicker. Same officer gets hurt chasing down drug dealer. Repeat offender, large amount of coke in pocket, none of this roach nonsense, out on parole, etc. They give him only four years probation, but they keep his $13k in cash and make him pay a parole fine every month.

Revenue generation. Nothing but.

When I "road trip", which is frequently during the race season, I typically get pulled over on the expressways. I have found the TN state boys to be some of the fairest and nicest.

Maybe things work differently in the States, but going riding here without the correct plates means you're riding without insurance on your vehicle, including basic liability.

With the medical costs being what they are, riding without insurance seems like a pretty good way to go bankrupt.

You can be insured without tags. You call your insurance company and insure the vehicle via its vin. then bring proof of insurance to the dmv to get your tags.

That's how I bought mine. I discussed it with the seller in significant detail (also my first bike, I was getting the hang of how the sale/movement/registration process would go). The takeaway was "don't plane to ride it home".

Hope this helps, welcome to NC. In spite of some of the wacky laws, I do like it better than NY.

i do this one in a wile, just to transport unlicensed things around. i have talked to a couple cops about it and they were understanding. with the random scanning of plates these days though i never keep them on and that is a real shame because now i need to rent garage space for every project i have going because cars/bikes without plates get towed. and cars with fake plates get taken.

I used the plates off of my silver pontiac firebird to drive my silver camaro home…. one plate on each car. We passed a cop. Luckily he didn't notice the two cars one plate number lol. He probably thought his scanner just picked up the first car twice haha

The best thing to do is save the old license plates from bikes you buy and then you have plates to use on bike that won't trace back to you if you run from the cops…… I wouldn't recommend running from the cops… especially on the skittles ninja! and that my friend is why I kept my plate. that and to swap it onto my CB when it is finished or return it to cancel my insurance on that bike and get a refund

In the UK there is no flexibility whatever. Plates and the annual disc are strictly the one vehicle. Also all vehicles not on the road, ie the junker you are using for parts or restoring, must also be re registered annually as 'off the road' with the government.
