Someone hit my bike while parked

Employee parking lot is being repaved, so I parked on the street.

A co-worker apparently can't parallel park. She came in and apologized and we walked out to look at the damage.

She backed into my bike "slightly"; aka, broke the foot peg and punched a hole the size of a quarter into her rear bumper. Tipped her over on the left side. Clutch lever and kick stand saved the engine and fairings.

She knew who I was and saw my bike when she got into her car; then backed into it. She didn't need to back up at all to pull out. She accused me of being right on her bumper and not leaving her enough room. ... If she was so uncomfortable, why didn't she just come in and ask me to move? Regardless, she was cooperative.

Anyway, through ebay in best and cheapest overall price,

Clutch lever: $30

Right foot peg: $10

Kick Stand: $10

Fairings: $0, just some paint

Total with shipping: $57; should be here on Tusday.

I'll get a better feel for damage when I ride home, no leaked fluids or anything else I could see. Yay for foldable mirrors and pegs.

Suggestions?

I sent the cost to her, but sorta need a foot peg and kick stand; given my bike is essentially my only mode of transportation.

Well if you don't and she decided not to pay you its going to be very hard to get the money later on out of her or insurance. I know in co its something like 72h to make the clame or you lose out

I just notified my insurance about the incident.

She's our Loans Collections officer who works in the same 1-story building as me.

Same thing happened to me yesterday...only it was me doing the running-over. Parked my bike behind my car and backed over it.

Well, because then you get to take the bike to a shop that you trust who will check for any additional damage, what if the frame is tweaked? A couple hundred dollars from her isn't going to cover that

Oh my. That sucks. I rode in a friend's truck once, following his own 1970 Root Beer Brown metallic Challenger with a Hurst pistol grip 4 speed. Nicest muscle you'd ever want to see. He rear ended it. Rear ended his own gorgeous muscle car.

It was painful to be a part of it, if only as a passenger. He had a great attitude like you, though. He laughed it off. I always remember this whenever I get a rock chip on a car/motorcycle that bugs me. Makes me feel guilty to get angry about it!

Didn't even think of that. I'll stop by mechanic's tomorrow.

Rode her home.

Fairings are definitely dented inward, like the fairing stay is bent.

Left handlebar is bent at the triple clamp.

Throttle is extremely sticky, thinking the release/throttle-off cable might be broken or disconnected.

Clutch fell out of second and third a couple times on the ride home.

Also, no foot peg sucks.

Mechanic estimated a best-case scenario of $400.

Mirror/fairing bracket is bent inward. Right rearset is bent inward, looks like frame tabs are bent. Left front footpeg is bent downward, but that may be the left rearset bent inward as well. Left handlebar is quite bent, bent rearward at the clamp and rear/downward after the clutch lever assembly.

She hit with enough impact to shatter the foot peg joint, and bend the rearset inward by half an inch on the bottom.

She's definitely a country girl, a city girl could have gotten out in a quarter the space.

So.... WTB Left handlebar, right rearset, left front foot peg, and possibly left rearset.

No noticeable engine damage, but the transmission has fallen out of gear a few times; and it's not supposed to do that. If the transmission was damaged, that's a whole lot of money, time, and labor; we'd have to split the engine apart. I'll make sure everything is tightened, lubricated, and pray it isn't transmission damage from the jarring of impact.

I'm getting a foot peg in early next week, once I replace it I'll be able to tell how much it is bent.

There is a fair bit of frame bracket damage, if we can't get it bent back into shape a used one is around $40.

No labor estimate yet, we'll know more by Thursday of next week; need some parts to determine the damage. Throttle was fixed with some adjustments.

Tally so far, days signify arrival date of purchased parts. '~$##' means estimate of non-purchased parts.

Clutch lever: $30 (Tuesday)

Right foot peg: $13 (Tuesday)

Kick Stand: $14 (Wednesday)

Fairings: $0, just some paint

Left Rearset (shift lever and peg, probably): ~$50

Right Rearset (probable): ~$50

Left handlebar (clamp looked good): ~$40

Transmission: No mechanic will do it in the summer, takes too much labor.

Let's hope frame bends back and transmission is fine. Keep in mind the above costs are through ebay and don't include labor.

/End message to her.

I'll do most of the work myself, but might as well get all shop/labor costs on insurance.

Wow Joel, you would think I hit the bike going 35 mph with ur list of damages. I'm going to let my insurance follow up with what is going on. I don't believe I was totally at fault, therefor I feel there should be a compromise on both parties. I backed into your bike, yes. But u were also butted right behind me, I didn't see u in my rear view and there should be 3 feet space between u and I. I can see replacing the $57.00 worth of parts that u indicated in your first email but I can't help but feel like your taking advantage of the situation. I think it's best that my insurance take it from here. They will be requesting a copy of the estimate of damages which is why I was asking for a copy from a professional mechanic. I am all about being fair, but I'm not going to be taken either. You have my claim adjusters information so if u have questions on reimbursement, etc. you can contact her. I apologize for the situation.
Not even the courtesy of proper grammar.
... ...

My reply

In retrospect, maybe I was a tad bit... pissed in my reply. Still shaking with frustration.

Quote:
Wow. Really? Basically the only difference between a tip over and a
low/medium speed laydown is fairing damage; which if you'll notice I
did not include.

Don't ever accuse me of taking advantage. Ever.

I asked multiple times what the cost was to you and quoted used parts.
My list of damages is roughly 50% of MRSP cost.

I was not 'butted up against you'. You backed into my bright yellow
bike, which was 5+ feet away. You didn't even need to back up to pull
out. You had at least 6 feet in front of you.

It would be less, except you creamed into my right side, breaking the
foot peg and bending the rearset. The damage would be less if I went
down at 35 miles per hour, because it would have only been on one
side.

Because our insurance system is so screwed up, you probably will get
by blaming some of the fault on me.

+1 to Jiggles.... Mine was run over and it looked fine, only after careful examination did I find that the fork was bent (besides other obvious damages)... Cost me a bundle!

Do you have any pics of the damages?

Sounds frustrating. I'm in a good mood so I'll let you have the parts cheap maybe just shipping and a couple extra bucks, I think I have the clutch lever too, it lost some of its paint on the bar end - if that makes any difference to you.

Well, she accused me of taking advantage with my last quote of ~$147 and being partially at fault.

So, I have put together a lovely parts quote from bikebandit. This includes all bent parts with no inclusion of fairing damage.

$883 retail, $709 from bikebandit.

Anything I missed?

Yup. there is a placeholder at the bottom of spreadsheet for labor. Mechanic opens in 20 minutes; I'll get a labor quote from him. He's been working on my bike since I got her two years ago, so he knows my bike.

UPDATE: Mechanic is putting together a quote for me now.

Mechanic didn't have enough time to get a full quote together, hopefully have it all on Tuesday.

Just went back and took a ton of pictures.

The parkable area is 44 feet, from my closest footpeg to beginning of angled curb.

A small SUV is 14 feet.

14 ft + 5 ft (buffer) = SUV.

Distance from driveway: 19 feet.

Her car: ~15 feet

Distance from driveway: 19+15 = 34 feet.

Remaining room: 44 - 34 = 10 feet.

My bag in the picture is 3 feet from my bike.

Just got back labor quote
Quote:
Joel, sorry to hear about the unfortunate incident with your motorcycle.

What follows is as close an estimate as I can provide without dis-assembly and closer inspection.
Labor rate is $78/hour.
Remove mirrors, fairing, instruments to straighten mounting bracket, reassemble;
1.8hr
Remove left bar controls, clutch lever, remove bar, reassemble with new;
.5hr
Remove kick-stand, spring, bracket and replace with new.
.4hr
Remove right footrest bracket, assemble new peg on new bracket and install;
.7hr
Remove brake pedal and replace;
.2hr
The frame may be bent where the foot-rest attaches, this may add some time to straighten;
.1-.3hr
The time estimated for this repair is just under 4 hours labor @ $78/hr = $300.00
Let me know if I missed anything.

What do you pay per hour? I've done most of my own stuff, except for carbs and valves because I have no garage or covered area.

He's the lowest cost in town by a lot too.

We don't have the hourly labor charges here. So its pretty cheap... I think I paid around 86$ for the entire 1000$ worth repair job I had to do after the same s*** happened to me. Labor's pretty cheap here in India, but on a more logical note I did have to pay almost twice the mrp for parts due to import duties. Kinda evens it all out when I think about it, plus my bike did spent about 2 months in the shop. ( oh the agony! )

er...

On second thought 300 bucks actually makes sense

Not necessarily. Our babysitter parked beside my car off the back right corner, and when wife and I backed out and I turned to do a three point in the grass, my right front bumper scrubbed her left front bumper. We called her outside and offered to get a police report - in our front yard. She declined saying there was already damage to the front air spoiler under the front anyway. OK.... that was August. In May she files a complaint against my insurance co citing the damaged air dam and the scuff I made. My insurance co didn't fight it, they opted to pay her $1200 and charge me higher insurance for 3 years. What a great company... Horace Mann if you care. I changed to a different company at the next interval. Screw a company that is supposed to help you and is all too happy to profit off you and not defend you.

Never never underestimate what an insurance company will pay out on without a police report.

Anyway, to the original poster here... you are very fortunate she came in and owned up to it. Most folks would have just driven off and not said a word. Something to be said for that.

I quite agree, hence the no-labor with ebay parts initial cost. Then she said I was taking advantage. So, $1088 for parts and labor through proper channels.

She Probly wanted the money for something. That sucks tho and its Probly why co has that law to stop this from taking place. If it was me I'd have not let my insurance pay for it.

I instructed them to not pay for it.... they said it was cheaper to just pay her 1200 and move on than go to court. That's the part that sucks... I had to pay higher insurance for 3 years. If I had stayed with that company, I would have paid THEM more than the 1200 they paid HER... so they made money by failing to represent my best interest. Turns out, it is in their favor to not represent my best interest. Who wouldda thunk it?

And yes, she was a senior in high school and was looking for some cash for when she went off to college later that summer... her car was never fixed.

ALWAYS take pics whether a police report is filed... it was stupid of me not to since I had a cell phone camera on me.

What's the going rate in your neck of the woods? Here it ranges from $90/hr to $125/hr.

After looking at the pictures of the offending bike, I can see that it is not a bright enough color of yellow. No one could have possibly seen that bike.... shame on you!!!

Any wagers on how loud pipes could have prevented this knock over?
