A MOTORIST from Liverpool still has a full licence after three speeding convictions and five for failing to tell police who was driving. He tops the list of Britain's highest 20 licence penalty point holders in figures just released by the Driver and Vehicle Licencing Agency. The usual maximum number of points before a ban is imposed is 12 but courts can make exceptions where a 'disqualification would cause exceptional hardship' according to the DVLA. Number two on the list is a man from Forest Hill in south east London who has six speeding convictions and another six for driving uninsured. He has 40 points - despite not even holding a licence. Third is a woman from Lancashire with a full licence after accumulating 38 points from 10 speeding convictions. At number five is a man from Didcot in Oxfordshire with 36 points after six convictions for failing to identify the driver at the time of an alleged offence. The figures were released under the Freedom of Information Act with a statement from the DVLA which said: 'In a small percentage of cases where the driver has accumulated 12 or more penalty points, the Agency understands that a Court can exercise its discretion and not disqualify the driver. In the majority of these cases, Magistrates’ or Sentencers may have decided to allow drivers to retain their entitlement to drive where it is considered that disqualification would cause exceptional hardship.'
