When I limo pulled onto that passing lane I thought he was trying to pass the a white truck in front, not slowing down and moved to the marked area. Well, it is the past, and I've been back on the bike that is all the matter. Thanks again. |

It might be easier if you just added "I was out of the country visiting my aging mother and families" as a signature.

Sorry for not reading this thread and responding sooner. You see, I was out of the country visiting my aging mother and families.
I will follow up soon with a reasoned literary composition. Ummm...as long as I don't have to unexpectedly leave town to...you know...visit my mother and families. |

Thank you for such a quick reply... Yes, it is over now and I would like to express my gratitude towards everyone's opinions, suggestions, good or bad, and a great sense of humor. My intention was to share my negative experience, so that some of us may learn from it. I have no desire for a law suite or to place blame on the driver. We all make mistakes from time to time. Hopefully, our mistakes would not be the cause of someone's life. I am new to forums such as this. So, I am still learning my way around. Thanks to you and to everyone who response to this thread.

Don't take criticism from forum members too personal or hard, they tend to be hard on riding errors and similar things, but are very helpful and supportive at the same time. Many members are just starting motorcycling, so, don't hesitate in bringing and posting your own experiences. I know that many of us has learned several things from this thread that you initiated. My best !

Regardless of how you do it, getting ahead of the guy with the paper work is always going to benefit you. I hope you did the right thing and found some sort of legal support because with the video evidence, and as everyone else have said, you have some sort of case. Also please ignore people who are saying the one who rear ends someone is always at fault, blah blah in Cali. That's not true. Before anyone acts like a lawyer, start referencing laws. |

As an armchair expert in all things, came here to tell you NOT to use your video in any official capacity. As others have stated, when the front end of a vehicle makes contact with the back of another, that's all they care about. You would need to otherwise prove some pretty extraordinary circumstances, but the video will only show you weren't prepared to avoid an accident. You speedometer is visible in the video, and although I don't remember the speed limit at that spot, 60mph is a little harry with all those limos flying across lanes. If I were the other dude's insurance, I would also argue that, although it is a no-stop lane, you should be anticipating extra carnage at that location....
No need to rub salt in your wounds, or repeat what others have said, but wanted to add the part about not using the video.... unless an actual lawyer tells you differently. Glad you weren't seriously hurt, and sorry about your bike. EDIT: The other observation I made was that you can almost SEE you target-fixate through the video.... practice looking for your escape(s), always. Ride on.

Hello sLick415, I only bought a liability for my Yamaha FZ6R this year. And there was no case in court. So the dust was settled with no further events.

Dude, be looking far ahead enough to see erratic driving patterns and stay the hell away from the vehicle if you notice wild or erratic driving. Looking ahead and reacting sooner would have helped you avoid the entire situation altogether. Glad you're ok. That could have been killer. Literally.

Thank you 'Fly'in Ninja'. The bike was too much work to fix it. I posted a 'give away' price tag for a bike handy man on CL, and it was sold right away.
As I mentioned on my earlier post, I like how my Ninja 650R take on turns and curves much better than my old FZ6R.

subxero, have you ridden on the new Bay Bridge eastern span? It is pretty good, I think the lanes are a little wider and there is a shoulder for breakdown cars and trucks.
