So i got my first ticket in june. no warning or anything. i am thankful that i got it from 180$ to 90$ just from being nice tho. whatever.
out riding with friend a few weeks ago. no license/permit. out of state license. no insurance or registration. insanely loud exhaust. its a gixxer 750. going down some back road doing about 60 in a 40 came up on a scion who slammed on the brakes to get down to speed limit cuz of unmarked state trooper sittin behind church. me and friend slow down but trooper decides to follow us. going along another state trooper pulls up behind the first one but nothing happens to him. yesterday its hot as balls outside. im sweating its muggy and im sticking in places i didnt know could stick. so i come to a stop sign to make a right flip up my visor to let some air in and notice a state trooper in the left hand lane to turn. i come to my complete stop look both ways i actually use my turn signal. i start going visor still up to let some air in for a few seconds. about 1.543384667392 seconds before i reach up to put down my visor the trooper throws the lights on. tells me that i was on a moving bike with my visor up. wasnt even doing 15 mph yet. and there was another stop light about 50 yds away that just turned red. 80$ citation for not having proper eye protection on a motorcycle. not even a warning or anything. just another "im ****ing bored and gotta meet my quota" ticket. funny thing is that while i was pulled over another kid on a bike drove by with his visor up. FML end rant. yes i know i guess i had a moving violation but seriously come on. __________________

That does suck.. but what can you.. some people have a poor POV on motorcycles.. it only takes a few assclowns to ruin reputations.
I think you were talking about your friend who didn't have the license, insurance or registration speeding right? I hope so, otherwise you have gotten away with a ton of stuff before getting screwed on a stupid visor ticket. In any case.. if you go to court.. try to get it down to 'no points'. You are going to pay money pretty much no matter what... good luck.

And yet another good reason I'm glad to be gone from PA. I hate PENNDOT with a passion for the crap they've put me through over the years. Then you have the state troopers that are oh so happy to push the limit of the crap coming out of PENNDOT and such.
Maybe try wearing sunglasses inside your helmet like I do. That way when you have your visor up you still have eye protection. Then when the statey pulls you over for having the visor up he'll stop short after seeing you have eye protection anyway. |

It's funny how things very so much state to state. Cops down here rarely even look twice at a motorcycle. I've of course her of bike being pulled over, but I have never seen a bike pulled over around here.
Of the cruisers in the area, I'd say maybe 50% of them have eye protection (probably 10% helmets and 40% glasses), the other 50% nothing at all. Sportbikes are a little better since probably around half actually wear a helmet, and a lot of the ones without helmets wear glasses. Then there's states like yours where you get pulled over for flipping the visor up. It's probably happened here also by some bored cop, but wow...what a bs ticket.

You sir have every right to be pissed.... bogus ticket. I've driven in PA too many times for my liking. They are pulled into the bushes every 15-20 miles on the interstate and do nothin but yank drivers... worse at month end.
Thought..... just wear rims (pull out the lenses) if you dont need to wear prescrip glasses and see if they notice... probably not and you can have a private snicker over it.....I would |

Egad man, that utterly sucks. Better'n a ticker for 60 in a 40, but still ouch. I should probably look into the regs down here, since I frequently ride 'round town with the visor cracked a notch so I don't fog up in all the humidity. Good luck with beating it.

I would imagine so, that seems to be all the cruiser guys with the half helmets have for eye protection if anything.

That is why i wear sunglasses under my visor, so i can flip up my visor for some cool air & still have eye protection. I've always used sunglasses instead of a tinted visor, you can flip up the visor & ride during the day, and i always ride with the visor down at night (without sunglasses)
My first ticket was for no eye protection around 1981, knew it was a law, but i stopped at a store about 100 yards from a ballfield i was riding to & just didn't put my sunglasses on with my visor up, since i was going such a short distance didn't think it would be a big deal. The copper saw me pull in with my visor up, wrote me a ticket, went to traffic court & it was knocked down to $25. |

Yeah, we require eye protection. $93.00. I do the same thing, though, and flip my visor up at stop lights and until I hit about 30+. I wouldn't stop anyone for it. The way I look at it, motorcyclists aren't really going to hurt anyone but themselves.

Solution - Ride with sunglasses. Eye protection. I can ride around with my visor up all day if I wanted

I didn't know that was a violation. I usually have it up an inch if I'm going <30mph.

The key to note is the eye protection. If you have it up an inch and it still covers your eyes you should still be good.

Excluding cycles under 50cc (where helmets are optional over the age of 16): Anyone under 21 must wear a helmet. A rider over 21 may ride without a helmet if they have insurance covering themselves for a minimum of $10,000 in medical expenses caused by an accident. PIP on motorcycle insurance is not available in FL so it must be health insurance that doesn't exclude motorcycle accidents. FLE won't pull someone over for riding without a helmet unless they look underage, but if pulled over for something else and they ask for proof of the insurance and it's not there, that's one more citation they can get on the stop. The Florida vehicle code also states "A person may not operate a motorcycle unless the person is wearing an eye-protective device over his or her eyes of a type approved by the department. " |

Yeah, it's because it came in two steps. First came a straight helmet law (gotta wear it) - I think around 1997 or 98, not long after I moved to Florida. Then about 3 years later the tourism industry (Daytona bike week fills a lot of hotels and restaurants with people that hate helmets) successfully lobbied and had another section added to the vehicle code with the exception waiving the helmet requirement for over 21 with insurance.

That's a bit crazy - a fine because you had your visor up? I often flip up my visor while stopped at intersections: sometimes I flip it down before pulling away, sometimes after.
It's hard for me to picture getting a ticket for that when I see so much crappy cager driving going on around me...

Very good info addy126. I thought it was interesting that in Louisiana there is no accustical requirement for mufflers which means I can have my mufflers as loud as I want and not get a ticket.

It really does depend on the state. In WA, you don't need eye protection if you have a "windscreen"... So, does that apply to the 250 wind shield? Who knows... But, I have prescription polycarbonate eye glasses. They should pass any states eye protection laws

Bummer man, hate you got a ticket for the visor up.
Eye protection not required here in NC, but I get some funny looks from cops when I've had my visor up...

The other week a cop on campus gave me a "put your shield down" hand motion as I drove in the other direction, first time I even thought that someone would get stopped for having a full-face open going slow
