I think part of issue is code's very, very vague and subjective:

I mean... I might be overthinking it a little bit, but I would define "safely" in such a way that "I didn't wreck when someone changed lanes" is safe, at a minimum.

In hindsight, it's pretty straightforward to figure out something wasn't 100% safe. Looking forward though, a rider can do everything humanly possible while splitting and still not be 100% safe. It's about risk management / risk minimization; we're all fooling ourselves if we believe it's about risk elimination.

It goes back to riding in a way that allows you to stay in control. Once the actions of other drivers determine whether you crash or not, you're seriously risking your life.

While we may argue over the fine points of lane splitting, the Frence don't give a woot. Anything goes at any speed. We spent a lot of time riding around Paris, private cars, buses, taxis, and never saw one crash. A few close calls, but no wrecks. Try the stuff in New Jersey and you would get run over. People seemed to give the bikes a little leeway. Not much, just enough to keep from killing anyone.

Just update my case. The police report said it is my fault for the accident. My attorney dropped my case. I made big mistake for not taking any pictures before I moved my bike from the accident scene so I don't have any evidence to prove the van driver's fault. Fortunately I am completely recovered after 2 months and I am glad that I can play tennis without any pain now. I might sell or donate the bike soon. |
