"The turn we recently took, after we thought we were moving forward, was unexpected. We thought we had secured funding, but in the end, we were not able to get the funding in place. Therefore we need to do the best we can under the circumstances for all parties in interest," Buell said in a statement.

The company is closed for now, Buell said, and is seeking protection under a state statute which is similar to federal bankruptcy law. Attorney Michael S. Polsky will be the court appointed receiver at the company's request. Bids will be solicited for the company as part of the Chapter 128 process, with the winning bid to be determined by the court.

"To say this setback is a disappointment does not begin to express what I feel right now. I am personally grateful for the support of our outstanding workers, customers and vendors. While this is a sad ending, I personally hope for a new and better beginning," Buell said.

Ugh, that's too bad. I've owned one Buell (a cheap one), and am unlikely to be interested in another one anytime soon, but it's still a shame that they can't make it work.

Got tired of throwing money at a company that couldn't sell bikes.

This news really doesn't surprise me. I mean, the bike was ugly, and for about the same price you could have a gorgeous Ducati Panigale.

That's exactly what I was wondering as well... From what I know of Hero, they are well known for screwing people over... Maybe that's what happened? They got what they needed from EBR and conveniently backed off?

That is exactly what would appear to have happened.

It was a business move on their part, they needed engine designs which erik is very good at so they threw money at him to satisfy him for them. Now they're taking the engines and selling them the exact opposite way erik was, in cheap bikes. Erik's business plan makes no sense without backing from a larger motorcycle firm or building a much higher quality product that destroys the competition, which he didn't quite do yet.

I still have a lot of hope for buell in the future, but his is a very difficult path. With how refined everything is these days to start a new sportbike company from scratch and be at all competitive is amazing. Sure he wasn't winning, but building a bike that could even take points in wsbk was impressive in it's own right.

There is speculation that this is more a financial/liability/paperwork problem to move some debt around, rather than the end of the company entirely. Stay tuned for a couple months to see if it gets reborn in a restructured fashion, still connected with Hero. Time will tell.

I just heard about this. Sucks BIG time. I like Buells/EBRs. My boyfriend has a Lightning he rids and just got a Firebolt to fix up in the hopes of lowering it so i can ride it. He really wants one of the new EBRs too.


I hope Erik Buell can bounce back with something.

Wow, this is disappointing. I was born and raised in East Troy, WI and this was one of the few recognizable things about the town. That and Stevie Ray Vaughn dying at Alpine Valley. I could always say I'm from where Buells are built. I can't say I'm that surprised though.

A local motorcycle shop (SMF Cycles) was trying to move up from selling Hyosungs and started working on a new shop that was supposed to open a long time ago. They had a huge setback right before they were supposed to open (and had already closed the old shop) when thieves broke in and stole almost all of their inventory (they had lots of used bikes of all makes and models).

Anyway, they finally opened about a year ago as an EBR Racing dealer with a huge EBR Racing sign on a giant pole like a truck stop might have for advertising prices to Interstate traffic. Giant set-back #2.
