Someone backed into my parked bike!

Took out my bike for the second time and had to go to Ace Hardware. Was at the register and one of the employees came to me and told me that someone had run my bike over! So I rushed out and to my relief, my bike was not run over! After a half hour of arguing about him giving me his insurance information he finally gave it over. He wants me to check how much it will cost before I call the insurance to see if he wants to pay it out of pocket. So I was wondering how much would it cost to replace the front fender and the the whole front haul as see in the pictures.

Pull up a website that has OEM parts and check on it, such as ronayers.

Also, where was your bike parked?

I would have called the police and filed a report and called the insurance company immediately. Never have and never will settle any incident like that without getting both involved.

It was parked on the street in front of the store. I has about 8 feet behind him and he had more than 10 feet in front of him.

His error, he pays for it.

You got is phone number too right? You could be a nice guy and get an estimate to have it fixed and ask him for a check. If he falls through, then file a claim.

But since he was an a** about it. Skip all that and just file the claim yo and enjoy.

Looks like serious damage! Check your forks and your frame were the front end connects for damage. Is there any wobble when you rode it home? In my area you're supposed to park the bike at a 45 degree angle to the curb, not sure what the practice is over there.

Yea I got all of his information plus pictures of his car. I think the worse part of it he said " I'm the nice guy who didnt just hit your bike and left without saying something, I could be home right now."
I think i scared him when I told him if he doesnt give me his info and he leaves and I know his name and have a picture of his car and plate plus a picture of his face.

It rode fine back about 5 miles didn't notice anything. Yea I normally park 45 degrees but I was literally in the store for 2 minutes when it happened.

And thus is why America is on the downfall. What used to be common place behavior is now considered "being nice," since immoral values are taking hold of our society...but that's a different story.

Straight onto his insurance, get the store clerk's details as a witness, and see if there's CCTV footage too before it gets erased.

He'll probably have already claimed that a bike ran into the back of him & try to go after you.

Insurance up. If needed, lawyer up.

If I get into an accident, I plan to go the proper route and involve my insurance. That's why I pay for it; that's how I'm going to use it. Therefore, everyone else should do the same for me.

I dunno about Milwaukee but I'm actually a bit worried your bike legally might be totalled. KBB says the bike is worth $1500 which means if the damage is past (at least in Nevada) ~$800 you're looking at getting a check for a new bike.

What would happen if they would total it? Could i tell them I want to keep it and fix it myself? Ive never really been in an accident ( KNOCK ON WOOD!) so I dont know how this all exactly works.

Yea I got the insurance but did not get full cover. Only got full coverage over metal parts. Still had to pay out of pocket to get the bike released. Insurance pay over will take another month. Plus I lost my no claim bonus, now have to pay increased yearly premium and resale will also be affected by this since I was planning to sell it with out any accident records.

Oh and the bike's scratched at random places as well and the stem nut and my dashboard are kind of an eye sore thanks to the careless service. My bike was in pristine condition before this happened.

Well, I'll explain how my total went. After I got the estimate insurance called and said it was a total loss and offered me (to round off some numbers) $4000. I asked what the salvage value of the bike was and it came out to $1000 -- I opted to take my bike back, which meant I got $3000 plus the bike as salvage. The bike being salvage means that I cannot operate the bike on public roads without the state doing a pretty thorough investigation of the repairs I did, and that the title will forever be a 'branded title' (you actually have to turn in your title and get a new one), so if I were to sell the bike that would be an issue.

Update!!
Just got of the phone with my insurance agent.
All of his information that I had given them had matched up with what he had given me.
The only issue now was that his policy number that he gave me was not right...
The agent told me that State Farm recognizes his name and everything in the system but the policy he had with them is over 2 years old and he did not get a new one. So I do not know if they wrote the incorrect number down when I was reporting my claim or if the guy gave me the incorrect number. If he doesn't have insurance, I will need to go to small claims court with him to settle the issue.
The agent did not mention anything about totaling the bike or anything in that nature. He told me that I am not at fault and his insurance will have to cover the expenses.
So now I am waiting for my agent to get back to me and see if he was able to get in contact with him for an accurate policy number.
Going back to Ace to get statements from the employees and names and seeing if they have any security footage of the incident.

It being your first accident I would expect you to be nice like you were. But I from now on will get the police involved. I have just seen to many people get screwed. Call the police. Its on the record, Names, drivers license numbers etc. File the police report, and doing that doesnt require you to go through insurance either. It doesn give you something to fall back on though.

Another update...
My insurance agent called me today and was finally able to reach the other guy. Long story short the guy tried to blame me and say that I was parked illegally and he backed into because he didn't think anyone would be parked behind him ( which is complete Horse****!) But my agent asked the guy if their was kids playing behind his car and he backed into them that they would be at fault and I guess he didn't have anything to respond to that. But in the end my agent told me that they know it was not my fault and they are marking my down for not a fault so my insurance premium wont go up. I was then contacted by his insurance and they asked me the same question my agent did and told me someone will be stopping by tomorrow to check out the damage and appraise the damage on the bike. So we will see what they have to say and see how much they will give me for the damage.

Do your own estimate, price parts at bikebandit or ronayers.
Then add $200 for labor.

Be prepared to be low balled.

In contrast, I have been involved in 3 crashes and none were my fault. In all incidents the other party did have insurance. Police were involved though because there were vehicles that were unable to be driven.

That is my biggest worry. Getting hit by someone who doesn't have insurance. I still worry even though it's illegal to not have insurance in the state of Florida.

It's also illegal to not have insurance here in Maryland. I had an old beater in college, still worth maybe 2 grand. Got hit from behind, went to the hospital. Person who hit me got a $150 fine for not having insurance, and they were on welfare, so suing them wouldn't do anything. Had to pay all my medical bills and borrow money from my girlfriend's parents to get a thousand dollar car.

Last update!!! Well I am beyond happy of the called that I just received!!
His insurances company appraised the damage and are writing me a check for $1027.75 Which should be plenty of money to cover everything. Now I need to decided if I want to get a dealership to replace it for me or if I should just buy it online.
Any suggestions?
