Totalled. Anyone with experience?

So long story short my bike got totalled and i am gonna send off my title to progressive this friday.
I wasn't at fault but apparently they are gonna hold onto my deductible since i didn't file my police report (don't do this!) and they couldn't get in touch with the other driver (who was at fault, he backed up into me at a red light)
Anyone has been though this? Anything to watch out for or just go with it as is?
Should i still file a police report about...hmm..the other driver going mia?

Sorry that this happened to you, Arnold !!!

If it happened today, you may try doing a police report in your local station.

Let's call @Alex and @Jiggles

In California you need to send in an accident form to the DMV anytime there is more than $500 in damage. Not sure what the laws are in Hawaii.

My bike was just totaled too.. sorry to hear about yours.

I requested to meet with an agent directly instead of sending my title in. That sketches me out. I wanted to get my check handed to me in person.

Are you happy with the check they're giving you? Because you have some leeway... For example I told Allstate that I had installed new chain and sprockets and it raised the value of my bike by $37, it's not much but little things like that can help you get a better check from the insurance company. Aftermarket exhaust, etc.

Otherwise there's not much you can do, but if it wasn't your fault you really shouldn't have to pay the deductible. I never heard of not filing a police report as reason for having to pay a deductible but I guess it depends on your particular state laws.

they are paying under your collision coverage it seems so deductible applies. In CT it is mandatory you file a report with dmv if damage is over $500. Now, what proof do you have they backed into you? they could say you crashed into them... Any witnesses?

Just to clarify, the property damage threshold for reporting to CA DMV is $750, not $500.

And to go even more off topic, the threshold to go from petty theft to grand theft was recently raised in CA from $400 to $950 for most common forms of theft.

Snipped from DMV Form SR-1 (which is the form CA DMV requires one to fill out in case of a reportable incident) at http://apps.dmv.ca.gov/forms/sr/sr1.pdf, top of page 3.

DMV SR-1 Instructions.jpg

What do you mean the insurance company couldn't contact the other driver? You took down the info from the other driver's license, registration, and insurance, the license wasn't counterfeit, and matched the address on the vehicle registration, right? Sounds like the insurance company needs to work a bit harder.

Thanks for everyone's input, but this is the part the bothers me too.
How is this even possible? Obviously i am not gonna hire a lawyer for $500 but this is a horrible reason.
As for the witness side, there aren't any but since it's a intersection, there are bound to have traffic cameras around there.
Hmm..at least $3400 isn't too bad, and i am glad i am not hurt at all.
Now the question is what bike should i get next!

If you ever get into an accident ever again NO MATTER HOW SMALL OR HOW NICE OTHER PEOPLE involved seem to be

YOU WILL WAIT FOR POLICE

YOU WILL GET POLICE REPORT

YOU WILL TRACK DOWN WITNESSES

YOU WILL HAVE POLICE ASSIST YOU IN OBTAINING VIDEO FOOTAGE

YOU WILLL NEVER EVER EVER PUT STUFF OFF OR THINK THAT IT WILL WORK OUT ever AGAIN!

People will act all friendly and say… its my fault sorry… then call the police and say you hit and run on them. People will not look out for you … you have to look out for you!

If you are buying a 3400 dollar bike?

what kind of bike are you looking to get?

If it involves property owned by someone other than you always get a report. ALWAYS.

I almost did not get paid for that $1,000.00 in damages. It would have sickened me just as much had it only been $250.00.
