fix it ticket questions ?!?!? got ticket harassed

Hi i am from Virginia, Northern Va close to Washington D.C.

I have court for 4 tickets I got about 1 month ago and I need help to get them voided.. The cop was an AYE HOLE and decided to write me up 4. that's fairfax county for ya.

1. DRIVING WHILE HEADPHONES ARE IN
only 1 headphone was in and i could hear everything around me.
isn't that the rules for cars too?

2. DEFECTIVE EQUIPMENT (for the tires)
my tires still had tread in them -.-

3. HIDDEN TAGS
my tags were bent just a little bit, if you look at it it is perfectly fine to see.

4. NO LICENSE
i know this one can't be fix but is there a way to void this?

Doub't you're gonna get much sympathy around here if you were driving without a license. My advice would be to get in touch with a good lawyer. They can probably get some of the charges dropped/reduced,.. that is if you can pay.

In the end that's really what they want from you. Remember, "money talks"

The middle two you can appear in court and have cleared and say you have had fixed/repaired -- or at least in NC. The first I've never seen, the last I'm not sure -- no license on your person or no license at all?

Ya thanks I'm mostly worried about the 1st and last one.
And no license on me, so they towed the bike -.- so i had to get ride to get my L then go to the towing place to get it back...

I'm just worried about having my name in the system as "NO LICENSES TICKET" (like a ticket history or whatever)
whenever they run my plates. Is that possible?????????

Not much you can do here aside of show good intention. I know the hour is late, but if you can get your permit before showing up in court, it should be a point in your favor.

Ask if traffic school will null the points on your lic.

Well it would seem as though they are all fairly minor offenses -- definitely seems like the officer was having a bad day.. It's good to see you have a license so if you show up to court with that [and paying fees] you will be fine:

A lot of legal mumbo jumbo, but essentially says if you have been convicted of failure to display license, and you show up to your summons with a valid license, then you will be considered as in compliance with the provisions in that section.

Headphones issue is considered a moving violation worthy of 3 points:

The tires and tags issue.. They both appear to be considered non-moving violations -- Fix both issues [Buy a new tire, bring receipt and photograph] re-mount the license plate [bring photographs from multiple angles? Perhaps?].

It may be wise to find legal consultation at this point.

No license? Yeah **** you, pretty much. All the little emotes and txt smilies won't get any sympathy from me. Especially after that whole NYC fiasco.

For the earbuds, tires and plate you could get an attorney but without having taken pictures at the scene of the plate and tire tread you're probably SOL against the officer's word.

chilllllll foo' it was for not having it on me. What NYC fiasco are you talking about? Yeah i'ma just go in there and say I fixed em. cept for the earbuds.

Wow that cop really was being an . I got pulled over a couple years back and didn't have my license because I lost it few weeks prior. I told the officer that, and he looked up my history based on the name on my school ID card. I think I still got cited for not having my license on my person, but it was a verrrrrrrry small amount.

Not sure it counts as harassment if your plate is hidden so you get pulled over and give the cop the opportunity to find all the other violations you were apparently running.

Not harassment, just probable cause. Why do folks give LEO's the opportunity to pull them over?

OP, get your license, fix your bike, grow up a bit and move on.

Yep I have forgotten my license once. However, I try not to open myself up to getting pulled over.

I was pulled over many years ago back in NJ. Didn't have insurance card with me. (had valid insurance, just didn't have the card in the car with me). Cop gave me a ticket for not having the insurance card ($25 and no points), instead of the speeding ticket ($XXX + points). After that I considered never bringing my insurance card, with hopes of similar generosity in the future, but figured it was probably a one-off experience.

Hi
Just a quick update to everyone that has been very helpful and informative on this post. I had shown up in court with no lawyer.
I explained the hidden tags was clearly shown. I DID have my licenses just not on me.I had forgotten it. The defective tires were replaced and showed receipts.

I ended up only paying a small fine for the headphones. Apparently having headphones distracts your attention and impairs your judgement according to the judge.

In conclusion the Judge was sympathetic when it was brought to his attention that this was my first offense.

I am relieved I do not have to take any classes or lose any points. It has been quite a experience being pulled over for the first time and receiving 4 tickets.

I am going to miss using headphones when I am riding. Does anyone recommend any helmet with built in headphones?

as someone who wears hearing aids, that makes no sense to me. I can hardly wear a hat while I'm wearing them without setting them off they'd be screeching in my ear the whole time under a helmet.

as for the tags and the license, you need to lawyer up there it sounds like either you're saying the wrong thing or you've been put down as though you don't have a license at all.

Yet, the MSF course encourages you to wear earplugs.

I just moved back to TN from VA. IMnsHO, the Virginia legislature has never seen a law they didn't like unless it applies to firearms. It's worth your time (& money) to pay attention to the news so you can keep up with what they just made illegal if you're going to live there. Virginia State Police are very well trained and equipped, and they are ... diligent ... in fulfilling their duties. If you get one ticket for something that pisses them off (no license, tag not clearly visible, dark tinted car windows, etc.) you're very likely to get a whole handful of tickets. That's just how they roll.

I wear earplugs a lot, frequently at work (and if not earplugs, then a noise canceling headset, all day long) and always on my motorcycle. In noisy environments, they make it significantly easier to hear what's important. There is no comparison to audio headphones. None whatsoever.
