House Fire Follow up
So I previously mentioned that my house burned down and I lost the ninja in the process.. I have some pics.. I'm trying to sue the landlord.. turns out his ex wife owns the house and didnt know he was renting it.. I checked with the town.. they have no records on the house so I dont know if that helps or hurts.. I lost over 10k in property damage.. no one was hurt... pics!
Some pics of the bike as well.. shes still standing on the t-rex stands i bought about a month ago. over the winter I installed a zg db windscreen, proton turn signals and bike monkey integrated tail light. the day before the fire i just finished the bike monkey, took all the fairings off, spent hours wiping them all down from dust and dirt, polished the chrome exhaust, and reassembled everything. I was going to be in PA for the weekend so I didn't want to take her out until I got back and had the time to ride. I left to visit my father in PA with the bike sitting in the porch... that was the last I saw of it. Please watch the video, you can tell I really loved this bike. Last I ever saw.. spotless

Wow the pics are amazing. THat fire was so hot it melted every bit of aluminum from that bike (sans the engine which was probably just a bit too much Al mass to completely melt. But the rims, top of the tripple tree, and anything else that was alloy on the bike is gone.
Sorry for your sad events, but the pics just intrigued me.

Here we have renters insurance. If the tenants don't have this insurance and there's a fire it's their loss not the responsibility of the building or house owner. The owners only insure the building not the contents. I sure hope it's different where you live and you do get some compensation.

It was a very messy situation, none of us had renters insurance, there was no real lease, the landlord didn't own the house and only collected in cash, he had done a lot of illegal electrical and structural work on the house without permits from the town, he has not returned the security deposit, his wife owns the house, the fire report states it was a outlet malfunction due to a downed power line during the storm and worst of all, i didnt insure the bike during the winter. I can't believe he didn't own the house and is going to get away with this.. I was unaware you can collect rent from people living in a house you don't own and not be responsible when something like this happens
ps. he owns a nice mercedes truck and i know where he lives...

As far as I know you cannot do that, or atleast not here in Oklahoma. A guy pulled that on my sister in law and he is now in Tulsa Country prison for 15-20. If you don't own the property you cannot collect rent on it as you have no legal claim to it. I would talk to a lawyer they will know your state and city laws. I have a feeling you could sue him for a fair sum of money. Now actually collecting the cash could be a different story.

I'm definitely looking into getting a lawyer, but i doubt this guy would be able to cough up any money anyway, so i'd end up paying a lawyer a load of money and never collect anything.. im not sure if its worth it but im still figuring things out.. in addition to class and work ): i can't believe this happened just as it started getting warm again..

Coming in a bit late here....wow, those pics really gave me the willies...
I feel awful for you. It is absolutely devastating. A few years ago, my sister was living in a house that burned down. They were not home, thank God, when it started. They arrived home from dinner to find the house almost completely engulfed. My brother in law tried to go inside to save their animals and couldn't get in the door. When I got there, the house was still burning and my sister was a screaming disaster. Every single thing they owned either burned up in the fire or was smoke and water damaged. They lost everything, including their dog and two cats, and had to start over in a new place with nothing but the clothes they'd been wearing the night of the fire, their cars, and the contents of her purse. I am so sorry this happened to you. By the way, have you contacted the Red Cross? They were a HUGE help with my sister, and if I remember correctly they actually arrived, of their own accord, shortly after the fire trucks got there. They got them new beds within a week, and gave them vouchers for food and clothing as well. Posted via Mobile Device |

I just want to point out that the assumption that you can only rent property you own is wrong. There are rules for subletting, but it is common. There may be rules that require him to have insurance. Look it up.

He might have insurance to cover the building but not the belongings inside..thus why there is rentee's insurance...which is a really cheap thing. Also, house insurance does not cover gas powered vehicles, if a car/motorcycle is burnt down by a fire started in your house, they are not covered by the home insurance, that's how it works here as I asked this question specifically. I'm really sorry for you but having insurance would have been your responsability, good luck suing.

Yea, I definitely should have had rent insurance. As for insurance on the bike, I wouldn't have been paying for coverage during the winter anyway..
I want to try to prove the fire was his fault and that his insurance should cover the damage. Town Hall has no records or permits on the house for one reason or another. The house obviously has had a lot of work done on it and poor electrical wiring from an unlicensed contractor may very well be the cause of the electrical fire. The town keeps records of any work done on any house and requires permits for most construction. Hard to prove it though considering the lack of evidence (house).

Dude sorry about your loss of the bike and personal stuff but for a very little outlay in cash you could be riding a new bike now. Personally I would sue the guy and his ex wife. Since she actually owns the house she can be held liable for the fire and everything in the house maybe. The actual owner of the house can be fined she is responsible for knowing what is going on with the house. Renters insurance is dirt cheap and as for not insuring the bike in the winter that is a big mistake especially on a newer bike, sounds like the excuse of young kids buying 10K sportbikes and only having liability, what happens when they total the bike, they are out 10k and are stuck paying a loan for years on a bike they no longer have. I hope you get a new one eventually and this time keep full coverage all year round.

Loan contracts always require that the borrower maintain full coverage insurance on the bike or vehicle specifically to avoid this. If the borrower fails to do that and the bike is totaled then the bank will call the note and the full balance will be due immediately. Then the lawyers get involved and it gets real ugly.
